Texting While Driving Facts:
New reports and findings show that drivers who are using a cell phone while driving are more dangerous than drunk drivers and cause a greater number of serious injury and wrongful death.

Cell phone use while driving accounts for a large majority of the Missouri & Kansas car accident cases at Horn Law. According to a national distracted driving study, manipulation of a cell phone while driving, including texting, dialing, navigating, browsing the web, checking e-mail, updating social media, etc., makes it 23 more times likely that a driver will be involved in a collision.

Moreover, a recent State Farm online distracted driving survey also shows a dramatic increase in the number of drivers who are accessing the internet while driving. This is called “webbing” and the survey shows that drivers using the internet went from 13% in 2009 to 21% in 2012. We can expect this percentage to rise as traditional cell phones are being replaced with more powerful smart phones. Given this trend, we can expect distracted drivers to represent over 25% of the drivers on the road during 2013.

The most common type of distracted driving accident, including texting and driving, are rear end collisions that cause traumatic injury to the head and neck, commonly referred to as whiplash. Horn Law also handles a significant number of cases that involve a distracted driver who violates a traffic control signal and causes a broad-side collision.

As a Kansas City crash injury and wrongful death lawyer, we have found that distracted driving accidents result in a greater force of impact because drivers who are manipulating a cell phone or another portable electronic device typically do not brake in time or take other action to avoid a collision

If you have been a victim of a car accident caused by a driver who was inattentive or was using a cell phone, legal consultation with a distracted driving lawyer is important and involves special considerations. First, these types of cases are cases of aggravated liability and involve more than just ordinary negligence. Our legal system recognizes aggravated liability when a person knows or should have known that their conduct is dangerous and causes a substantial risk of harm to innocent people. Second, distracted driving cases involve the need for special investigations in order to preserve evidence and prove cell phone use. Special legal efforts are required in order to obtain the cell phone data from the appropriate cell phone carrier.

Finally, from a legal standpoint, the only way to obtain a fair and full insurance settlement to fully compensate you is to use an attorney who has experience in handling a distracted driving case. By full compensation we mean that the settlement to our client must reimburse them for all past, present, and future damages. Damages are not only related to financial and personal loss, but more importantly, concern your pain, suffering, aggravation, interference, disability, etc.
